Terms of Service

Last updated: 18 October 2026

These terms are the agreement between you and PhoneUse. They explain what we provide, what you pay, what you may and may not do, and what happens when something goes wrong.

01Who we are

PhoneUse is run by Masta, Inc. In these terms, "PhoneUse", "we", "us" and "our" mean that company. "You" means the person using PhoneUse, and also the company or organization you use it for.

These terms cover our website (www.phoneuse.com), the console (console.phoneuse.com), our API and MCP server (mcp.phoneuse.com), our docs (docs.phoneuse.com), the PhoneUse CLI, the AI Copilot and every phone you rent from us. In these terms we call all of this the "service".

02Agreeing to these terms

  • By creating an account, buying a phone or using the service, you agree to these terms and to our Acceptable Use Policy. Our Privacy Policy explains how we handle personal data.
  • If you use PhoneUse for a company or other organization, you confirm that you are allowed to accept these terms for it. That organization is then bound by them too.
  • PhoneUse is for business and professional use. By using it, you confirm that you are using it for your trade, business or profession, not as a consumer.
  • You must be at least 18 years old to use PhoneUse.
  • You may not use PhoneUse if you are in, or ordinarily live in, a country or region under comprehensive US sanctions, or if you are on a US government list of restricted people or companies. You must not use PhoneUse to send software, technology or data where export or sanctions laws forbid it.
  • If these terms and the Acceptable Use Policy ever disagree, these terms win. If you have signed a separate written agreement with us, such as an Enterprise contract, that agreement wins where it is different.
  • If you do not agree to these terms, do not use the service.

03Accounts and teams

  • You can sign up with an email address and password, or with Google. Give us true information and keep it up to date.
  • Keep your login safe. You are responsible for everything done with your account. If you think someone else has got into it, tell us right away at abdulla@phoneuse.com.
  • Phones, orders and API keys belong to an organization. An organization has two roles: admins and members.
  • Only admins can invite people, change roles or remove members. Only admins can buy phones, add per-minute funds or cancel orders. An admin can also let an API key or CLI login start a monthly-phone checkout. Per-minute funds and per-minute phones always need a signed-in admin. Members can use the organization's phones.
  • Admins are responsible for who they let into their organization and for what its members do.

04What PhoneUse provides

Cloud phones

Android phones that run in the cloud, on systems run by our cloud phone infrastructure providers. You can rent them monthly or by the minute. You control them in the console, or let AI agents control them through our API, MCP server or CLI.

Real iPhones

A real iPhone, tapped by a robot hand. Real iPhones are not sold online: you book a call with our team, and we set the phone up after the call. Each action takes a few seconds, because a physical arm makes every tap.

Real iPhones are billed monthly, at the price shown on www.phoneuse.com or the price agreed on the call. Unless we agree something different in writing, the renewal, cancelling and failed-payment rules in section 7 apply to them too.

The AI Copilot

An assistant in the console that controls a phone for you when you ask it to. It acts as you, with your permissions. In its default Auto mode it asks you first before it starts an agent run, acts on more than one phone, or takes over a phone someone else is using. Other steps, like tapping, swiping and typing, happen as soon as you ask. You can switch a chat to Ask mode to approve each step. The Copilot cannot install apps, buy anything, manage API keys or change your team.

Agent runs

An agent run gives an AI agent a goal to work on by itself. Runs do not carry out goals that move money, erase an account or the phone, change a password or security setting, or sign out of an account. They hand those steps to you instead. This is a safety net, not a promise: it relies partly on the AI model and may not catch every risky step.

API, MCP server and CLI

Tools that let you connect your own software and AI agents to your phones.

We may change, add or remove features over time.

05API keys and connected agents

  • An API key lets software act for your organization. Treat each key like a password. Keep it secret and give it only the access it needs.
  • If a key leaks, revoke it in the console right away and tell us at abdulla@phoneuse.com. Do not just rotate it: after a rotation the old key keeps working for a while.
  • You are responsible for everything done with your API keys, your CLI logins and the AI agents and apps you connect. That includes actions that cost money or change what is on a phone.
  • AI tools you connect, such as an MCP client, receive the screenshots, screen text and action records they ask for. Those tools are run by other companies, under their own terms.

06Prices and payment

  • Prices are shown on www.phoneuse.com and in the console. They are in US dollars and include tax. You pay the price shown at checkout.
  • Payments are handled by Stripe. We never see or store your full card number.
  • If you have a promotion code, you can use it at checkout. A code lowers the price only for as long as the code says.
  • We may change our prices. A new price applies to purchases made after the change. If we raise the price of a monthly plan you already have, we will tell you before you are charged the new price, so you can cancel first.
  • A per-minute phone keeps the rate it started with until that phone ends.

07Monthly cloud phones

  • Monthly plans are paid monthly, and each month is a 30-day period. You pay for the first period when you order.
  • Your first period starts when your phone is ready, not when you pay. It is a little shorter, about 28 days, so that each renewal is charged two days before the phone's time runs out. After that, each period is 30 days.
  • Your plan then renews automatically every 30 days until you cancel. We charge the card that paid for the first period. If that card can no longer be used, we charge your default card. If there is no card, Stripe sends you an invoice.
  • This also applies to phones bought with a promotion code, including free ones.
  • The console shows the date you are paid through.
  • Some plans bought before 17 October 2026 may still renew once a calendar month instead.

Cancelling

  • An admin can cancel at any time with Cancel order in the console. Cancelling stops the next charge.
  • You keep the phone until the end of the period you have already paid for. Then it ends.
  • Cancelling does not give you a refund for the current period.
  • Before your phone is ready there is no Cancel order button. Contact us instead.

If a payment fails

  • If a renewal payment fails, we may try the charge again. If it stays unpaid, your plan ends and you lose the phone.
  • If you dispute a payment with your bank, or a payment is refunded, the phone it paid for stops right away.

08Per-minute cloud phones

  • Per-minute cloud phones cost $0.024 per minute for each phone. You pay for the exact time a phone runs. Part of a minute costs part of the rate. You pay from a prepaid balance that belongs to your organization.
  • You add funds through Stripe. The smallest payment is $5.00, tax included. What you do not use stays in your balance.
  • If you start a phone without enough balance, we ask you to pay the missing amount, and at least $5.00.
  • When a phone starts, 10 minutes of rent for that phone is set aside from your balance ($0.24 at $0.024 per minute). It is used as the phone runs.
  • You are not charged while a phone is being prepared. Charging starts when the phone is ready, and keeps going until you end the phone or your balance runs out.
  • Leaving a phone idle, stopping a run or closing your browser does not stop the charge. Only ending the phone does.
  • When your balance is about to run out, we tell you, about 10 minutes before. When it runs out, the phone ends.
  • When a per-minute phone ends, it is switched off and we have it wiped, as our Privacy Policy explains. Do not count on getting anything back from it.
  • If the rate changes between choosing a phone and paying for it, the phone does not start and your money stays in your balance.
  • If your payment arrives more than an hour after you chose a phone, or after that phone is no longer available, the money goes into your balance and no phone starts.
  • If the service is interrupted while a phone is running, we stop charging at the last time we could confirm the phone was running.
  • Only admins can add funds and start per-minute phones. API keys cannot spend your balance.

09No refunds

  • All payments are final and non-refundable, except where the law requires a refund. This covers first payments, monthly renewals, per-minute funds and any unused balance.
  • Cancelling a monthly phone stops future charges. It does not refund the current period.
  • You cannot get a refund in the console. If you think we charged you by mistake, email abdulla@phoneuse.com and we will look into it.
  • If we do decide to refund a payment, the phone or order it paid for ends.
  • Nothing in these terms takes away refund rights that the law gives you and that a contract cannot remove.

10Delivery and phone models

  • We set up a cloud phone after you pay. Setup is usually quick, but it can take longer. Delivery times are estimates, not promises.
  • Phones come from our cloud phone infrastructure providers. What they have available changes, and a model can sell out.
  • If the model you paid for sells out after you pay, we may set up a similar model instead. It will have the same Android version, the same region and at least as much memory, at no extra cost to you. We tell you in the email that says your phone is ready.
  • If we cannot set up a phone you paid for, we will contact you to sort it out.
  • If you cancel a per-minute phone while it is still being prepared, it is switched off and the minutes set aside for it go back to your balance.
  • If a phone stops working, contact us at abdulla@phoneuse.com.

11Acceptable use

Our Acceptable Use Policy is part of these terms. Please read it. In short, you must not use PhoneUse:

  • for anything illegal;
  • for fraud, or to deceive a person or a service for gain;
  • to sign in to, recover or hold accounts that are not yours;
  • to break another service's terms, or to get around its security in a way it does not allow;
  • to break the law or anyone else's rights;
  • to attack or overload PhoneUse, get around its security or limits, or reach other customers' data.

When you use the AI Copilot, you must also follow the usage rules of the AI model providers it uses. Today that includes OpenRouter's terms (openrouter.ai/terms) and OpenAI's usage policies (openai.com/policies/usage-policies).

Not sure if something is allowed? Ask us first at abdulla@phoneuse.com.

12Apps and services on your phones

  • The apps, websites and accounts you use on a phone are run by other companies. You must follow their terms and rules.
  • We are not responsible for those apps or services, or for what they do. That includes an app blocking, limiting or closing an account you used on a PhoneUse phone.
  • You must have the right to use every account, app and piece of content you put on a phone.

13Your content and data

  • Your content stays yours. Your content means what you put into PhoneUse: the data on your phones, your instructions and prompts, and your Copilot chats.
  • You give us permission to store, process and show your content as needed to run, support, secure and improve the service, and to follow the law.
  • Data on a cloud phone, like app logins, files and messages, is stored on the phone itself, on our cloud phone infrastructure providers' systems. We do not back it up. Keep your own copy of anything important.
  • When a phone ends, the data on it can be erased, and it cannot be brought back.
  • We keep records of the actions taken on your phones, as our Privacy Policy explains. Ending a phone does not delete them.
  • When your content includes other people's personal data, we handle it for you and only to provide the service. Under laws like the GDPR you are the controller of that data and we are your processor. If you need a data processing agreement, email abdulla@phoneuse.com.
  • If you send us feedback or ideas, we may use them without owing you anything.
  • PhoneUse itself, including its software, website and brand, belongs to us. We give you a limited right to use the service under these terms. The PhoneUse CLI also comes with its own license.

14AI can make mistakes

  • The AI Copilot and AI agents use AI models made by other companies. AI can misread a screen, misunderstand you, tap the wrong thing or do something you did not expect.
  • Check anything important yourself before you rely on it.
  • What the Copilot or an agent does on a phone is done for you, and you are responsible for it.
  • An AI model provider may refuse a request. When that happens, the Copilot cannot help with that request.

15Availability

  • We work to keep PhoneUse running, but we do not promise it will always be available or free of errors. There is no uptime guarantee unless we agree one with you in writing.
  • Phones can be paused for maintenance. A restart of our systems can interrupt an action, or end an agent run that is in progress.
  • Parts of the service depend on other companies, such as our cloud phone infrastructure providers and AI model providers. When they have problems, the service may too.

16Suspension and ending

If you want to stop

  • You can stop using PhoneUse at any time. Cancel your orders first, so you are not charged again.
  • You can delete your own account in Account settings in the console. Deleting your account does not cancel your organization's orders or delete its data.
  • To delete an organization, contact us.

If we need to act

  • We may limit, suspend or end your access, revoke API keys or end phones if you break these terms or the Acceptable Use Policy, if you do not pay, if we need to protect the service, other customers or other people, or if the law requires it.
  • Where it is reasonable, we will tell you why.
  • If we end your access because you broke these terms, you do not get a refund.
  • If we end a phone you have paid for, or close the service, for a reason that is not your fault, contact us at abdulla@phoneuse.com and we will sort it out with you.
  • Ending access does not delete records of what already happened, such as action records.

Parts of these terms that should keep applying after they end, like payments owed, no refunds, disclaimers, limits on liability, indemnity and governing law, keep applying.

17Disclaimers

We provide PhoneUse "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties beyond what these terms say. This includes any implied warranty that the service is fit for ordinary use (merchantability), fit for a particular purpose, or does not infringe anyone's rights, and any promise that it will work without interruption or errors, or that phones, apps or AI results will be accurate or complete.

Some places do not allow some of these limits. Where that is so, they apply only as far as the law allows.

18Limitation of liability

To the fullest extent the law allows:

  • We are not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data, lost or blocked accounts, or business interruption.
  • Our total liability for all claims about the service is limited to the greater of (a) what you paid us in the 12 months before the event that led to the claim, and (b) US$100.

This applies to every kind of claim, including in contract and in negligence.

These limits do not apply where the law says liability cannot be limited, for example for fraud, or for death or personal injury caused by negligence.

19Indemnity

If someone makes a claim against us because of how you used PhoneUse, your content, the apps or accounts you used on a phone, or because you broke these terms or the law, you will cover our reasonable losses and costs from that claim, including reasonable legal fees.

20Changes to these terms

We may update these terms. When we do, we change the "Last updated" date at the top. If a change is important, we will tell you by email or in the console before it applies.

If you keep using PhoneUse after a change applies, you accept the new terms. If you do not agree, stop using the service and cancel your orders.

21Governing law and disputes

  • These terms are governed by the laws of the State of Delaware, USA, leaving aside its rules about which law applies.
  • If you have a problem, please email us at abdulla@phoneuse.com first, so we can try to sort it out.
  • Any dispute will be handled by the state or federal courts located in Delaware, USA, and you and we both agree to those courts.
  • If you are a consumer, you keep the rights that the law where you live gives you and that a contract cannot take away. That includes the right to bring a claim in your local courts, where the law allows it.

22Other legal terms

  • These terms, the Acceptable Use Policy and any written order or agreement you have with us are the whole agreement between you and us about the service.
  • If part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • You may not transfer these terms to someone else without our written OK. We may transfer them, for example if our company is sold or merged.
  • Neither of us is responsible for delays or failures caused by events outside reasonable control, such as outages at providers, natural disasters or war.
  • We may send you notices by email or in the console.
